My Baby got charged today.

They are set on criminalising My Girl. And I am premenstrual. Don't fuck with me.

The trick is to play a rarely used card.

The merest hint that the booking officer had intentions as he herded her, alone and frightened towards the cells and the game, I'm afraid, is up.

From what you've said before (and if she's got half her mother's vim) I'm sure she's fine, but I hope she knows that sundry heavy-set bald men with too much eye-shadow, Olive-oil moguls, Late Middle Aged Idiots and Myopic big-hootered retailers are rooting for her.

I'm surprised you don't know what the charge is.

I would hazard a guess that it's one of two:

Affray - Public Order Act 1986 s.3

Disorderly conduct - Public Order Act s.5

Affray is the more serious charge of the two. 'Frightening the Public' doesn't sound like any statutory wording that I know of.

She needs to be honest with herself and her solicitor about whether she's guilty or not - that way there can be bargaining. She is entitled to see evidence in order to prepare a defence.

Kev, I don't know what the charge is. She did tell me but all I can remember is that it is Section 4 of something, and I think I recognise it because I had a man prosecuted under it myself when he was randomly punching women in the face down in Monument Tube back in the mid 80's. The did him for frightening me, not breaking some poor girls nose.

I'm trying to be impartial, Lilith.
I don't doubt she's done nothing wrong, but in the extremely unlikely event that she has then it's no good trying to be clever with your CPS brief - that really won't work.

If there's police corruption suspected then that needs to be addressed vigorously - I would suggest early legal advice is key here in order to gather evidence.

Old Holborn's idea has some merit. Why not explore it with one of these 'rottweiler' QCs ?

Yay ! She has options.

Fight them and shame them. We must defend the right to protest. Your daughter was hardly breaking windows, as e.g. the mob did to the Duke of Wellington in 1831 (and how many, if any, were punished then?). If you need us to put in something for QC fees, please say so.

Very useful link. I imagine they will find it hard to prove. There is a lot of footage of her being peaceable and smiley and that is just what I have seen on the BBC. But they have arrested some women she was next to, and one of them threw something, she tells me. There was evidence of a police officer at the demo, spotted yelling bash the pigs by a journalist who was also there. He spoke to her and denied he was a policeman before melting into the crowd.

Also - I can't remember how 'intent' plays into this.

Intent is extremely difficult to prove without an admission or overt evidence - not so sure of its meaning within the POA 1986 (over 20 years now). I would think the definition of intent (mens rea) is exactly the same as that which divides manslaughter and murder.

I'm thinking that without a signed/taped confession or unwitting admission from the defendant the charge can't stand.

Her intent was peaceful protest. Everything about how she behaved on and after arrest confirms that. I think they will be pushed to prove otherwise.

The other thing that seem out of order to me was that she was arrested on the say so of a WPC who said she saw my girl assaulting a police officer with a barrier. This charge has now disappeared. It looks like a set up to me.

Newmsie, schools find bright children tiresome. They will come to you, concerned, and say something like " I am very worried, Newmsie Jr wont sit still, and he can't focus on anything" You will be worried at first and then you will see that Newmsie Jr has no trouble focussing for hours on deconstructing the kitchen cupboards or Mummy's make up bag or painting himself with ketchup and you realise that Newmsie Jr is simply BORED STIFF at playgroup.

to be honest lilith...i am at a bit of a disadvantage as i know nothing of your laws per say...i do feel i know you and i am sorry you are having to get your hair up about this...it doesn't seem fair and to ruin your daughter's reputation, it should be worth a bit more in my opinion...it's amazing to me the crime i have witnessed while in parts of the UK and nothing is done, yet your precious daughter scared someone...seems remarkable to me...keep up the good fight my friend and if you need anything this way, you have my email! xx

They appear to have given up harassing the criminal classes and now try to make up their numbers by criminalising decent people who would never dream of breaking the law.

L did you read the story of the gay horse? A student in Oxford was arrested for telling a copper that his horse was gay - it was deemed a hate crime. He didn't accept a caution and allowed it to be taken to court where it was promptly thrown out.

Sounds like S4 Public Order Act. That would mean that she is accused of making somebody believe that he/she was in danger of immediate unlawful violence. That has to be a specific person not a general threat. Presumably the arresting officer?

When they charged My Girl they showed her some footage of CCTV. My Girl came away confident that they cannot infer that she broke any laws from the footage they showed her.
